Hal Anthony, of Behind the Woodshed, has pointed out this section of the Lieber Code, which was brought in during the Civil War, which outlines a principle that holds today:
"The presence of a hostile army proclaims its Martial Law."
They didn't need to officially declare martial law in Boston. It was declared by the presence of the military in civilian areas, operating in a military capacity.
